Under the Iowa Implied Consent Law, refusal to submit to an Iowa OWIexamination a driver s privilege will be revoked. If refusing examination, the driver will be subject to a 90-day waiting period to apply for a temporary restricted license. What is the DUI penalty for a CDL driver?

If operating a Commercial Motor Vehicle, it is illegal to have a blood alcohol concentration above .04 percent. When in possession of a CDL, there is automatic consent to testing alcohol in the body. If charged with an Iowa OWIordriving under the influence in whichever state the CMV is operated, the CDL will be confiscated, suspended or revoked.

The commercial driver s license will be suspended for one year if operating a CMV and:

What is the DUI penalty for a minor?

A driver under the age of 21 is considered a minor according to Iowa law. Under the .02/”zero tolerance” violation,a minor may not hold any alcohol in their body while operating a vehicle. Penalties vary depending on each Iowa OWIcircumstances:
